1. Agreement to these Terms
These Terms of Service govern access to and use of the Nabbol Athletics websites, applications, and related services. By creating an organization, purchasing or activating a subscription, or using the service, you agree to these Terms and the Privacy Policy. If you use the service for an organization, you confirm that you have authority to bind that organization.
2. Eligibility and accounts
You must be legally able to enter into this agreement. You are responsible for accurate registration information, safeguarding account credentials, assigning access only to authorized people, and promptly notifying Nabbol Athletics of suspected unauthorized use. Organization owners are responsible for the activity of users they invite and the permissions they assign.
3. The service
Nabbol Athletics provides tools for athletic organizations and private coaches, including organization management, athlete and guardian records, programs, seasons, teams, registration, waitlists, rosters, events, attendance, locations, billing, communications, and analytics. Features may change as the service develops. We will not materially reduce paid core functionality during a current billing period without reasonable notice, except where necessary for security, law, or service integrity.
4. Organizations, athletes, and minors
Organizations control the records they enter and determine who may access them. Each organization is responsible for obtaining all permissions, notices, releases, and consents required to collect and use athlete information, including information about minors, photographs, performance information, attendance, and guardian relationships. The service is intended to be administered by authorized adults and is not a substitute for an organization’s safeguarding, background-check, medical, emergency, or parental-consent procedures.
5. Fees, subscriptions, and payment
Plan features, user limits, billing intervals, and prices are shown during registration or in subscription settings. Paid subscriptions are billed through the identified payment provider. Unless otherwise stated, fees are non-refundable except where required by law. You authorize recurring charges for the selected interval until cancellation takes effect. Taxes may apply. Cancellation normally takes effect at the end of the current paid period unless the service states otherwise.
6. Acceptable use
You may not use the service to violate law or another person’s rights; upload unlawful, abusive, deceptive, or harmful content; exploit or endanger a minor; transmit malware; probe or bypass security; interfere with service operation; scrape or access data without authorization; impersonate another person; or reverse engineer the service except where applicable law permits it.
7. Customer content and data
You retain ownership of content and data you submit. You grant Nabbol Athletics a limited license to host, process, transmit, back up, and display that content only as needed to provide, secure, support, and improve the service and meet legal obligations. You represent that you have the rights and permissions needed to provide the content. Data handling is further described in the Privacy Policy.
8. Third-party services
The service may integrate with identity, payment, email, mapping, hosting, analytics, or other providers. Their services may be governed by separate terms and privacy policies. Nabbol Athletics is not responsible for third-party services outside its control, but will select and manage service providers with reasonable care.
9. Availability, suspension, and changes
We work to keep the service available but do not guarantee uninterrupted or error-free operation. We may suspend access to protect users or the service, respond to legal requirements, address non-payment, or investigate a material violation. We will provide notice when reasonably practical.
10. Disclaimers
To the extent permitted by law, the service is provided “as is” and “as available.” Nabbol Athletics disclaims implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty that the service will produce a particular athletic, business, health, or safety outcome. The service does not provide medical, legal, safeguarding, or professional coaching advice.
11. Limitation of liability
To the extent permitted by law, Nabbol Athletics will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or loss of profits, revenue, goodwill, or data. Nabbol Athletics’ aggregate liability relating to the service will not exceed the amount paid for the service during the twelve months before the event giving rise to the claim. Some jurisdictions do not allow certain limitations, so those limitations apply only to the extent lawful.
12. Indemnity
To the extent permitted by law, an organization will defend and indemnify Nabbol Athletics against third-party claims arising from that organization’s content, its users, its violation of these Terms, or its failure to obtain required permissions and consents, except to the extent caused by Nabbol Athletics’ own unlawful conduct.
13. Termination
You may stop using the service and may cancel as described in subscription settings. We may terminate access for a material breach, unlawful use, prolonged non-payment, or where continued service would create legal or security risk. Provisions that by their nature should survive termination will survive, including payment obligations, ownership, disclaimers, liability limits, and dispute provisions.
14. Governing terms and disputes
These Terms are governed by the laws and courts identified in the operator details maintained by Nabbol Athletics, without regard to conflict-of-law principles, unless consumer law requires otherwise. Before filing a claim, each party agrees to give the other reasonable written notice and attempt in good faith to resolve the dispute.
15. Changes and version history
Each published version has a version number and effective date. Material changes will be communicated through the service or by another reasonable method. A new version applies from its effective date; prior versions remain available on the public Terms page. Continued use after the effective date constitutes acceptance where permitted by law, but fresh affirmative consent may be requested for material changes.
